In the crazy world of trademarks, it's up to the trademark holder to police the industry and bring lawsuits to bear on infringers. If they don't pursue infringers, the trademark can be revoked. That's why the big guy sometimes has to look like an asshole, suing the little guy over something as trivial as a name.
